Probate

If a relative or loved one passes away with a Will (testate) or without a Will (intestate), chances are that person’s estate will have to be “probated” unless the amount qualifies for distribution by way of small estate affidavit or unless that person transferred his assets into Trust. If probate is necessary, you need an attorney to assist you in preparing the documents required to open the estate in court, to provide guidance in preparing an accounting for approval by the heirs and legatees, and to prepare the documents necessary to close the estate with the court so that the assets of the estate can be distributed.
